Are You a First Principle Thinker
In last weeks New York Times Corner Office column, Adam Bryant interviewed Abe Ankumah, CEO and founder of the software company Nyansa. Ankumah discussed the importance of cultivating first principle thinkers in your organization. He wants people who dont just to creating a solution without first understanding and defining the problem in a crystal-clear fashion. Heres Ankumah explaining his first principle approach:
I think startups kind of take on the value system of their founders. There are three of us who started the company, and were all first-time entrepreneurs. We tend to be very first principle thinkers. What I mean by that is when youre trying to solve a problem, you start by trying to understand the essence of the problem, rather than starting with what the answer should be and then working your way to justifying it. So its all about making sure that everyone understands the problem were trying to solve. And to do that, you have to maintain a broader perspective and listen very carefully to people.

Asacub A New Android Malware With Multiform Threat

Asacub is a new Android threat that has been used by bad actors to infect thousands of users in Russia in a recent SMS spam campaign.
According to the experts from Kaspersky Lab, the Trojan-Banker.AndroidOS.Asacub was first detected as a new spyware Trojan. The experts noticed that one of the C&C servers used by the Asacub Android malware (chugumshimusona[.]com) was also used by the Windows Trojan CoreBot that appeared in the wild in August 2015. In September, CoreBot was said to have
In September, the CoreBot Trojan was improved to work as a banking Trojan, and the Asacub threat evolved in the same way.
The researchers observed and intense activity of the malware that lasted an entire week from Dec. 28, 2015 to Jan. 4, 2016. The SMS spam campaign infected more than 6,500 unique users in Russia.
A blog post published on Securelist states:
During the New Year holidays, the new modification was actively distributed in Russia via SMS spam. In just one week, from December 28, 2015 to January 4, 2016, we recorded attempts to infect over 6,500 uniqueusers.
Tha last Asacub variant detected by Kaspersky was a banking trojan used to syphon banking data from infected devices.

The experts from Kaspersky highlighted that the Android malware has had at least three major modifications in a few months, the crooks used it as spyware and banking Trojan.
The first Asacub variant spotted in June 2015 was used to steal all incoming SMS messages from infected devices and implemented classic data stealer features and RAT functionalities.
A month later, in July, a second Asacub variant appeared in the wild, the crooks used it to target a number of European banks. The malware also implemented a reverse shell to allow operators to execute commands on the device and see the outputs.
Another variant uncovered in September 2015 was more oriented to banking trojan and included a series of phishing screens with bank logos, including a major Russian bank, used to steal bank card data.
The last Asacub variant discovered late in 2015 was able carry out the following new commands:
- GPS_track_current get the devices coordinates and send them to the attacker;
- camera_shot take a snapshot with the devices camera;
- network_protocol in those modifications we know of, receiving this command doesnt produce any results, but there could be plans to use it in the future to change the protocol used by the malware to interact with the C&C server.
The experts noticed that this variant does not include any phishing screens, but the analysis of the source code of the malware revealed the presence of the code used to target the banks.

When I was 10 years old I dyed my hair for the first time. On the rare occasion that my mom went to the hair salon, she took me with her one time. We went to the poshest salon in town, not the type where you bring your kids. (hippie-mom not being the type who likes getting her hair done, I know youre reading mom.) Chez Henri was a place where all the clichés of French hair dressers were a reality. While my mother was getting a wash on the other side of the salon, Henri himself came to me and asked; what is it that you want? I answered red-purplish hair. With no further questions asked that was what I got. Meanwhile the ladies next to mom asked each other; who takes their daughter to the salon and lets her do whatever she wants with her hair? To which mom calmly answered; that would be me. Making the rest of the 15 minutes they had to sit there with wet hair utterly awkward for them. After that day and seeing how hair can instantly transform you, I saved up all my allowances and had enough money every other month to buy a new color, I tried out every hair-coloring-kit available in the drug store. this pretty much went on until getting these colder tones between grey, blue and lilac, that Ive stuck to for the longest and feel most myself in.
So after reading my little hair resume, you could almost say that Im an expert with 15 years of experience that learned everything the hard way (=Dyes gone wrong, hair breaking, hair falling out). That doesnt necessarily make me qualified to give you actual advice on how to bleach and dye your hair, but I could give a few tips on how to take care of it. Which is a question that is asked at least a few times a week. First off, when going to nearly white it will damage your hair. A lot. Afterwards you will have to treat your hair entirely differently than before. These might seem like very small useless tips, but if you apply them all they will have effect and keep delicate, damaged and bleached hair healthier.
/W A S H I N G
I only wash my hair twice a week. The process of washing, drying it, styling it is often is too demanding for bleached hair. Also washing hair washes out the natural oils coming from your scalp, making the hair dry.
/H A I R T I E S
Always use hair ties without a metal part. After switching to softer ones I noticed a lot less breakage at that awkward ear-height.
/T A N G L E S
Always try to avoid tangles. Every time you brush and detangle you have the change of breaking and damaging a few hairs. So tie your hair up before going to sleep, when it is windy outside, or just whenever you can.
/L O W H E A T
Classic one; avoid using heat on your hair. If you have to, put your straightening iron or blow drier on low heat.
/C U T I T
This is probably the maximum length of my hair while being bleached. The terminal hair length has to do with the speed your hair grows versus the speed that your hair breaks. Obviously with bleached damaged hair it will break more. So find out what your length is and keep it at that or shorter to keep it looking healthy.

Arched Panelled Mirror A Softer Shape
This wall panelled with arched-top rectangular mirrors caught my eye. While the rest of the space may not be to my taste, these mirrors illustrate the power of repetition paired with restraint, yes? The clean lines, a simple arch, no muntins (the decorative dividers in windows and mirrors), paired with a decadent metal edge offer a very versatile piece. They create a linear effect, stretching the ceiling height, but the arches soften the shape. Grouped closely, they visually read as one element in this living room.

In a smaller space, the Abate Slatted Mirror from Anthro has a similar effect. Its huge, and brings a layer of patina into a more modern space, and its clean lines update more traditional styling as well.

ArcticDx v Sequenom A Human Gene Patent Litigation Settles
On November 16, a court in the Eastern District of Texas issued a consent judgment and dismissal with prejudice in the case of ArcticDx v. Sequenom. The patents at issue are what I would classify as gene patents - all of the patents include claims directed towards methods of identifying specific genetic variations associated with disease, particularly age-related macular degeneration (AMD). These method claims are analogous to the Myriad claims directed toward methods of identifying mutations in the BRCA genes, which the Federal Circuit recently held to be patent ineligible in Association for Molecular Pathology v. USPTO, i.e., the Myriad case.
I think ArcticDx v. Sequenom illustrates some point I have raised in earlier posts to this blog, including a post earlier this week reporting on the Supreme Courts decision to grant certiorari in the Myriad case, i.e., claims to isolated DNA sequences are probably not that big of a deal, and gene patent claims are generally not nearly so preemptive of genetic testing as the ACLU and other critics of gene patents would have us believe.
The lawsuit was filed by ArcticDx earlier this year, alleging infringement of one of its patents, and seeking a declaratory judgment of non-infringement of five Sequenom patents. None of the patents at issue in this case include a composition of matter claim, there are only method claims. Thus, the classic gene patent claim most people think about, i.e., the isolated DNA claim, is not represented in any of these patents. This is consistent with my view that, at least moving forward, isolated DNA claims are probably not that big of a deal. As I have explained on this blog, in articles I have published in venues such as Nature Biotechnology, and an Amicus brief I filed with the Federal Circuit in the Myriad case, there is good reason to think that few isolated DNA claims would be infringed by most genetic testing activities. Ironically, the Supreme Court granted certiorari solely for the purpose of assessing the patent eligibility of isolated DNA claims.
The five Sequenom patents are numbers 8,053,190; 7,867,727; 7,695,909; 7,351,524; and 8,088,579. The ArcticDx patent is number 8,114,592.
To provide a sense of the nature of the patent claims, claim 1 of the 579 patent recites:
A method of screening for susceptibility to developing age-related macular degeneration (AMD) in a subject by determining whether or not the subjects genome encodes a haplotype in the Complement Factor H (CFH) gene associated with reduced susceptibility to developing AMD, comprising determining whether or not a sequence encoding isoleucine at position 62 of the CFH protein is present at the polymorphic site rs800292 (SEQ ID NO:12) in the subjects genome, wherein the presence of said haplotype indicates the subject has reduced susceptibility to developing AMD.
Claim 1 of the 727 patent recites:
A screening method for determining a human subjects propensity to develop an abdominal aortic aneurysm and/or age-related macular degeneration (AMD) comprising: analyzing a biological sample from the subject to detect the presence or absence of a deletion of at least 1000 bp in the region of chromosome 1 between the 3 end of exon 22 of the complement factor H (CFI-1) gene and the 5 end of exon 1 of complement Factor H-related 4 (CFHR4) gene wherein the presence of a deletion indicates the subject is at increased risk of developing an abdominal aortic aneurysm and is at decreased risk of developing AMD.
For comparison, one of the Myriad method claims that was found patent ineligible is claim 1 of US patent number 6,033,857, which recites:
A method for identifying a mutant BRCA2 nucleotide sequence in a suspected mutant BRCA2 allele which comprises comparing the nucleotide sequence of the suspected mutant BRCA2 allele with the wild-type BRCA2 nucleotide sequence, wherein a difference between the suspected mutant and the wild-type sequence identifies a mutant BRCA2 nucleotide sequence.
Note that the Sequenom claims are much narrower than Myriads, restricted to specific genetic variations like 1000 base deletion and isoleucine substitution recited in the exemplary claims. In contrast, the Myriad claim purports to cover detection of any mutation in the BRCA2 nucleotide sequence, including mutations that were not identified at the time the patent was filed. This scope, and particularly the apparent inclusion within the claim of genetic variations which had not been identified at the time the patent was filed, has been one of the primary criticisms of Myriads method claims.
The consent judgment and settlement between ArcticDx and Sequenom is based upon the parties agreement that ArcticDxs AMD testing products and related activities, including Macula Risk, do not test for the specific genetic variations recited in Sequenoms claims, e.g., the specific 1000 base pair deletion or the isoleucine substitution.
I think it is worth noting the scope of the patent claims at issue in this case. In contrast with the Myriad claims, the ArcticDx and Sequenom claims appear to be quite narrow (and perhaps not overly preemptive of genetic testing). These two companies are currently competing in the market for AMD genetic testing, but based on the consent judgment the parties agree that ArcticDx does not need to test for any of the claimed genetic creations in order to provide services. Once again, I think this is consistent with the idea that gene patents, and particularly this sort of method of genetic diagnostic testing claim, is not necessarily as preemptive of genetic testing as some would have us believe.
As another observation, all of the patents at issue in the case are University patents Sequenoms patents were all assigned to the University of Iowa or the University of Pittsburgh, and ArcticDxs patent was assigned to Cambridge University. This is consistent with what I have found in studying gene patents, i.e., most of the gene patents which could have an impact on genetic testing come out of universities, including some of Myriads patents.

My job as a coach and trainer gets me around quite a bit. It is always thrilling to meet new people and to learn about all types of industries. During those encounters, I often get asked how companies like Google, Apple and Facebook do work. Before I left the USA for Switzerland, I used to work for ThoughtWorks out of their San Francisco office. During that time I had the chance to peek under the covers of a couple of those well known bay area players. Pretty much all of those companies are agile, not necessarily in a Scrum or XP way but they surely value their people with trust and autonomy. Yes, these are exactly the most important ingredients for self-organization.
The one company which I never even put a foot in was Apple I drove by twice a day but 1 Infinite Loop is a black box for me. So how does Apple do what it does? How could this company recover like a phoenix from the ashes? I admire Steve Jobs. He does magic on stage when showing Apples latest products. He has a strong personality and there are quite some stories floating around about his famous tantrums. So, how did this man turn around Apple? Well, to be honest I dont believe that it was a one man show completely; however this one man is in the exact right position.
Let me explain how I see the role of Steve Jobs though Scrum glasses.
Each Scrum team consists of one ScrumMaster, a Team and one Product Owner. For larger projects you can have more Scrum Teams working together, which is called a Scrum of Scrums. A company wide Scrum of Scrums enables the company to do agile product portfolio management , which is crucial to overcome the stasis of annual plans. At the very top of those Scrum of Scrums, you have THE Product Owner, the over-Product Owner, the one person responsible for what gets developed in which order. Steve Jobs is exactly this person at Apple. Sure, he is CEO and has absolute power. However, in contrast to other CEOs which are too far removed from the details, Steve Jobs is exactly interested in these details. He had the whole iPhone redesigned because it had more than one button. He decides to accept or not to accept the products. He gives the acceptance criteria and he has to like what he sees or it does not see the light of the day.
To me this confirms that one of the most critical roles in a Scrum Team is the Product Owner. Sure, the best Product Owner with a lousy team will not succeed either, but a great team can only be on top of the game with a great Product Owner.
The success of a project depends on the Product Owner, its role but more importantly the person, and definitely NOT how good or detailed the requirements are. A good Product Owner enables the Team to rise above and make a great product the right way.

/ As you can see Im not that fond of labels. Bare containers and bottles look less cluttered and more uniform on my shelf.
/ Some of you have send me messages about skin care routines. It is pretty basic and straight forward, I just try to keep my face 1/ as clean as possible, 2/ hydrated and 3/ protected against the sun (by adding some extra sunblock to my day cream).
/ A little over a month Ive been testing out this new Kiehls cream, and I cant let it go unmentioned. Specially during busybusybusy times where I tend to have less sleep, this little bottle has been a lifesaver in the morning. When really stressed, I like to take an extra minute or two to apply it and really massage it in, it makes your face feel completely awake and fresh again.

Baby Boy Number Four A Dollar Store Haunted Village
Well, hes here, hes still nameless, and every other boy (including my husband) in our house has the stomach flu. Its been quite the past few days! But this little guy has been nothing but sweetness! Sure Ive lost some restful sleeping hours, but Im just relishing every waking minute I have with him for now, because I know this tiny stage of life will be gone in the blink of an eye.
Ill be learning how to blend blogging life with a newborn over these next few weeks, so posts may be few and far between, or you may see a few reposts. But I really do love blogging. It gives me a creative out/distraction when I get bombarded with everyday life, so I wont disappear completely.
In addition to this precious little boy, I have a picture of what I was working on when my water broke Friday evening. Now every year when I pull this out, Ill be reminded of baby boy number four.
Desiree from The 36th Avenue shared this idea awhile back, and Ive been wanting to try it ever since! This year I finally got around to stocking up on dollar store houses for my haunted village.

I found some actual haunted houses at Dollar Tree several weeks ago, but now is the time to snag all the Christmas village items that are popping up on the shelves. They look quite wintry, but when you add a coat of black paint, some glitter, and embellishments, youve got your self a perfectly spooky town!

Art Is Definitely A Real Thing OK
I am waiting for the plumber.
He was meant to be here twenty-five minutes ago but has not showed up, and frankly I am beginning to feel rather rejected.
I wasnt sure whether or not he would need to turn off the water so, just in case, I have filled the kettle and two pints glasses full of water, imagining somehow that I might die of thirst between now and 11.30 when I have to leave for work, that Ben will come home to find me strewn across the floor like a bison, all ribs and woe.
(Some time later)
He is here now. Very, very clatterbangcrash-based activity going on upstairs. I am crouching over my computer trying to ignore the fact that almost as soon as he arrived and therefore I could no longer use (ahem) the facilities, I began to need a panic-wee. I am ludicrous.
He is big with big boots on, and has brought into the house a massive trolley with what can only be described as tools on it. Loads, though, not just the ones I understand like screwdrivers and hairdryers. I am a bit in awe of him. He can just wander into someones house with loads of bits of metal (welded specifically to be useful) and understand how a bath works and what to clatterbangcrash to make it into a shower.
I, on the very stark other hand, am nervously writing about him on the Internet. What forking paths we take. (Please note: forking to mean diverging, rather than a pretend swear.)
I am relieved that I am teaching this afternoon, so at least I can feel like I am giving something to society.
Yesterday I had an excellent day of working on The Project: 2012, which is a show that I am, along with two excellent friends, taking to Edinburgh next year for the festival. We are working together in some respects but each of us is creating our own work. My show is going to be about £$^*&()*_)*%£ %^&((* %^£@£&*@ &%$%$^*()%$$^^.
(I am not able to say it yet, because I am too scared. I have been practising saying HELLO I AM AN ARTIST AND THIS IS WHAT MY WORK IS ABOUT without wanting to throw up. What always happens is that I mumble something about a cello and then quickly say that I also teach so we can talk about teaching rather than AAAAAAAHHHHHRRRT (vomit) because its much, much, much easier and doesnt involve spontaneous panic-weeing.)
Yesterday was cool, though. I did, like, stuff and it was good. Part of it involves trawling the wide-eyed archives of this blog, which is pretty forking embarrassing, I can tell you. I quite like doing it, particularly because its for my ahrt and so not as self-indulgent as it could be. Although it is still pretty self-indulgent. Sometimes thats OK, perhaps.
Oh God. Is it acceptable to ask the plumber to wait outside the bathroom so I can have a wee? I might just risk implosion and wait until I get to the station, which also will cost me 30p. Maybe I will ask for some wee-money for Christmas.

Oh my God he just left the flat, not saying when he was coming back, so I locked the door to the flat and dashed upstairs (I would have just locked the door to the bathroom, but it was propped open heavily. I am not so mental that I have to lock the front door every time I have a wee). I wonder whether he has just intuited that I needed a wee so discreetly left for a bit. That must be the sign of someone who is good at their job.
This is all too dramatic for me when I have work to do. I cannot concentrate at all. My concentration ability must be extremely flimsy.
I am going to go and do some ahhhrt before I do my teaching (LOOK I AM NOT A WASTER I HAVE A REAL JOB LOVE ME LOVE ME VALIDATE ME, etc etc).

Are You A Workaholic Part 2
In Part 1 of Are You A Workaholic?, which appeared in our blog last Monday, February 11, 2013, Craig T. Norback presented a set of questions to be answered either with yes or no.
If you answered yes to between five and ten questions, you, too, must learn to slow down and work more efficiently as you are developing symptoms of workaholism.
You probably dont have a problem if you answered yes to fewer than five questions. However, Norback adds, even one affirmative answer if the behavior is compulsively pursued could be a danger signal that you are driving yourself too hard. So its time to take things easy by controlling your tendency to overwork.
How often do you get a good nights sleep and exercise? They are the key to staying on the job and reducing stress.
Successful company executives rarely miss work due to illness, despite long work hours and high pressure positions, says a survey by New Yorks Howard Sloan Associates in their publication, Search.
How do these executives do it? More than 90% say they exercise 1-10 hours a week, and 95% get at least six hours of sleep a night. The majority makes a special effort to eat a balanced diet, and 84% are non-smokers.
As a result, only 6% suffer high blood pressure, and 61% say they are in good physical condition. That translates into coping well with the high levels of stress they encounter on the job.
Self-help groups for stress management? Why not? Such groups beat the stigma of psychotherapy and can be just as effective in training you to kick bad habits, claims Dr. Stephen Lande of Temple University School of Medicine.
Self-help groups can focus on behavior techniques tailored to your needs, so you recognize those factors inducing stress, and train yourself to reduce anxiety levels.
For example, Dr. Lande says you could set a digital alarm watch to beep at specific intervals so relaxation exercises could be practiced for 10-15 minutes to ward off cumulative stress.

A few weeks ago I was helping our daughter to prepare a power point presentation about the upcoming US presidential elections. We spent a lot of time trying to understand the Electoral College system and thinking how to explain this to the other 9-year olds.
US Electoral College is not something straightforward and every four years I have to be reminded how it works. It is not intuitive - the majority doesnt always rule, as had happened four times in the past with the most recent in the year 2000 when George Bush won the presidency while loosing by 543,816 votes to Al Gore. It doesnt look fair at all - candidate can concentrate his campaign on the 11-12 largest states only, winning these states and not even bothering to get a single vote in the rest 4/5th of the country. These largest states will provide the required 270 electoral votes.
Silly us, why then we use this ridiculous system? I have searched the net for answers. It is believed that the founders feared trusting local folk with direct election of the president. Presidential campaigns have not been such lavishly funded and well-organized processes back in the late 18th century Lack of media and limited travel capabilities led to candidates being known mainly locally. How much that local New Jersey candidate may know about matters in the South? And what Southerner may have heard about this Jersey candidate without a Cable, radio and a car? It was proposed to choose a few educated and well-respected noblemen who will make this important decision on peoples behalf: electors. They will make sure to study the candidates. And in order to force the presidential candidates to address such electors across the whole country, they agreed to require the winner to get the majority of the all electors votes. This would also limit the number of candidates making the process simpler. Now it starts to make sense, but mainly in these specific historical settings. Nowadays, our candidates cross the country on a daily basis, we know more about them than we may want to. Do we still need such a complex system?
Turns out my daughter and I were not the only ones troubled with the electoral math. A recent MIT conference was devoted to this topic. Mathematicians and political scientists debated what is fair and why. It was noted that smaller states have an advantage in the current system as they get more electors per capita. It was pointed that the process of each state uniting behind a single candidate has an important political meaning. Few alternatives were proposed - an obvious popular vote, a bit cumbersome ranking system with each person marking the degree of his preferences for each candidate, and a system in which votes would be awarded by multiplying each states popular vote percentage by its number of electoral votes. You can read more in the MIT news here, I was just glad someone else was worrying about that.

Yesterday my daughter shared with me that they had a free lesson. While the teacher was busy discussing something with the boys, she told the girls to pick a game to play in the school yard. A few games were proposed and the girls voted who wants what. The problem, as my daughter stressed, that there is a group of four girls that always vote together. Shall one of them really want a specific game, they all vote for it. And guess what, their game always won! Does it remind you of anything? It is not a direct analogy with the Electoral College system but perhaps there are cases when uniting behind one choice does make sense.

Hello all!
Ive been absent from the blogging world for a while...a long while! Im happy to report that whatever it is that motivates teachers to create, share and blog has been rekindled in me. Last year was a wonderful year in a 5th grade dual language classroom. However, the learning curve was steep and my students were a wonderful, special and needy bunch! Which, did not leave much time for creation or energy for blogging.
Ill be teaching third grade this year, and am excited for the change! I havent been able to visit my classroom yet - so Im eager to get started! While anticipating beginning classroom setup, Ive been busy updating my Back To School packets!
